Bargain shoppers could teach attorneys a great deal about what matters and what doesn’t in pharmaceutical product liability law. These consumers who delight in the low prices of the dented and scratched “clearance” bins of their favorite stores understand the simple principle that not everything that goes “wrong” with a product makes that product dangerous. A toy with a misspelled label or a new shirt without a “cleaning instructions” tag may be a boon to a price-conscious consumer who understands that these products, despite manufacturing process mistakes, are nonetheless safe.
