Thomas Giacobbe applies his background in mechanical engineering to support clients’ intellectual property needs across an array of industries.
Thomas advises clients on the acquisition, protection, enforcement, and licensing of intellectual property. His practice includes drafting and prosecuting patent applications, including both provisional and non-provisional filings, as well as preparing office action responses and appeal briefs. He regularly conducts patentability, infringement, validity, and freedom-to-operate analyses, helping clients understand risks, opportunities, and the strength of their intellectual property positions. Thomas also manages U.S. and international trademark portfolios from clearance through registration, developing filing strategies, responding to Office Actions, and addressing domain name and online brand protection issues.
In addition to his intellectual property practice, Thomas represents clients in commercial litigation and business disputes across a variety of industries. He has worked on matters involving trade secrets, artificial intelligence, blockchain technology and the tokenization of real-world assets, restrictive covenants, and copyright law. His litigation experience includes drafting pleadings, briefs, and dispositive motions; managing discovery; conducting depositions; and overseeing large-scale document review projects. Thomas approaches every matter with a practical, detail-oriented mindset, focusing on developing the strongest strategy to achieve his clients’ objectives.
Thomas began developing his litigation and prosecution experience while serving as a law clerk in Tucker Ellis’s Intellectual Property Group during law school. In that role, he supported intellectual property litigation teams through legal research, case analysis, and trial preparation.
Thomas brings a strong technical foundation to his legal practice. He graduated from Southern Illinois University Edwardsville as Valedictorian in the engineering department and was selected as the university’s 2020 commencement speaker. He enjoys collaborating with inventors, engineers, and entrepreneurs to understand emerging technologies and translate complex technical concepts into effective patent protection. His patent prosecution experience spans a wide range of technologies, including exercise equipment, HVAC systems, pump systems, asset fractionalization, artificial intelligence use cases and training methods, decentralized trading methods and systems, other blockchain use cases, capacitors and circuits, air filtration and purification systems, vacuum technology, headphone technology, and wearable health-monitoring devices.
Thomas is committed to helping innovators protect the ideas and technologies they work hard to create, believing that effective intellectual property protection plays a critical role in fostering innovation and business growth.
Outside of his practice, Thomas enjoys golfing, playing soccer, DIYing, hiking, fishing, and spending time with his family. He lives with his wife, Gabriella, and their daughter, Adelina, in a home run by two Australian Shepherds.
