Maha Kabbash focuses her practice on the defense of pharmaceutical and medical device companies in product liability litigation.

Twenty-five years into her career, Maha is a soup-to-nuts litigator. Her practical experience infuses every stage of defending a product liability lawsuit – from drafting pleadings to written and electronic discovery, taking depositions of plaintiffs and treating providers, preparing and representing company employees at their depositions, developing expert reports and testimony, and engaging in motion practice – through trial and appeal.

Maha is a fiercely proud “Jersey Girl.” Outside of work, she loves live music of (almost) any variety, being groupie-in-chief at her husband’s and children’s rock gigs, and singing in the church choir. She also enjoys pilates, home design, and time spent down the shore.

  • Argued before New Jersey’s appellate court on the admissibility of trial evidence in FDA’s 510k clearance process for Class II medical devices and the availability of punitive damages under New Jersey’s Product Liability Act for 510k cleared medical devices, which resulted in the court vacating a multimillion-dollar verdict against the client
  • Served as co-lead trial counsel in three lawsuits brought against a manufacturer of pelvic mesh surgical implants
  • Developed a team of 15 medical liability experts for pelvic and hernia mesh litigation, including identification, vetting and onboarding of experts, development of reports, opposition of Rule 702 motions, and preparation for trial testimony
  • Prepared and defended more than 30 company witnesses at their depositions
  • Obtained multiple summary judgment dismissals in pelvic mesh lawsuits on statute of limitations and other grounds
  • Represented a manufacturer of breast cancer chemotherapy treatment in NJ Multi County Litigation proceedings
  • Represented a manufacturer of CAR T-cell therapy in responding to third-party subpoenas
  • Obtained summary judgment for a manufacturer of microwave oven drawers in a class action proceeding
  • Served as co-trial counsel in a five-month trial of a groundwater contamination case brought under CERCLA, resulting in the client’s trial victory
  • Achieved favorable settlements and summary judgment dismissals on behalf of a leading manufacturer of laptops in numerous consumer lawsuits in New Jersey
