On November 4, Tucker Ellis Trial Department Chair Karl Bekeny and e-Discovery Group Chair Anthony Petruzzi submitted to the Supreme Court of Ohio a letter in support of the proposed amendment to Ohio Civ.R. 26(B)(1). The proposed amendment would bring Ohio’s Rules of Civil Procedure in line with the Federal Rules of Civil Procedure in recognizing that proportionality is necessary to provide for the just, speedy, and inexpensive administration of justice in modern civil cases. It also would modernize Ohio practice by empowering judges to craft discovery orders relative to the needs of each individual case.

Tucker Ellis values fairness in the discovery process and submitted the comments to support our clients on this important issue. In sum, the letter says that the proposed rule “clearly and succinctly describes the appropriate scope of discovery, while making the proportionality concept already present in the Civil Rules’ ESI provisions generally applicable to all discovery and largely mirroring the thoroughly vetted and widely welcomed 2015 Federal Rules Amendments.”
