Tucker Ellis Client Brainlab Prevails in Fibertracking Case; District Court Judge Declares “Siege is Over”

On May 25, Tucker Ellis client Brainlab AG prevailed in a hard-fought patent infringement case in the U.S. District Court for the District of Massachusetts. The case dates back to 2012, when Brainlab and other defendants were sued over “fibertracking,” a technology that permits the visualization of white matter tracts in the brain. Over the last several years, all of the defendants settled but Brainlab. According to the plaintiffs, the financial impact to plaintiffs of Brainlab’s supposed infringement was over $240 million. On Friday, May 25, 2018, Judge Sterns granted Brainlab summary judgment of no infringement, concluding, “the siege is over and Brainlab wins.”
