Equality Ohio Quotes Chad Eggspuehler on Ohio Supreme Court Decision in Adelaide Transgender Birth Certificate Case

On November 19, Equality Ohio quoted Chad Eggspuehler in its statement regarding the Adelaide case. As the justices of the Ohio Supreme Court could not come to an agreement, a lower-court ruling remains in effect, affirming the denial of a transgender citizen’s application to correct her birth certificate’s gender marker to match her gender identity and introducing more uncertainty regarding the process for transgender citizens to correct birth certificate gender markers.
“Today, after more than three years of litigation, we are disappointed that this unopposed application for correction of birth certificate has been denied by a non-decision from the Ohio Supreme Court,” said Chad, who served as co-counsel with Equality Ohio Legal Clinic in representing the applicant in the case. “The absence of a precedential decision from the Ohio Supreme Court leaves unanswered important questions of law and leaves in place the disparate approaches taken by County Probate Courts.”
