On February 7, the California Court of Appeal, Second Appellate District unanimously upheld a trial court’s ruling dismissing a wrongful death case against Tucker Ellis client Ethicon Endo-Surgery Inc., reasoning that California’s five-year period within which to bring an action to trial had expired while the case was in arbitration.
