On October 16, Susan Racey presented at the Cleveland Metropolitan Bar Association’s (CMBA) 51st Annual Estate Planning Institute. Susan and co-presenter Amy Keating of Zashin Law explored the topic of bringing community property benefits to Ohioans. They focused on issues including the differences between common law property v. community property, elective community property states, and community property trusts (CPTs).  They discussed the potential benefits and drawbacks of creating a CPT and the status of Ohio’s initiative to enact legislation permitting CPTs in Ohio. They also provided an analysis of the draft Ohio Community Property Trust Act (OCPTA), which is being developed by the OSBA Elective Community Property Trust Committee, as well as unresolved issues involving the OCPTA still to be considered.
