Tucker Ellis Obtains Unanimous Defense Verdict for Client Mead Johnson in Product Liability Case Involving Premature Infant Formula

November 1, 2024

On October 31, Tucker Ellis obtained a unanimous defense verdict for client Mead Johnson in the Circuit Court of the City of St. Louis. The five-week trial involved a product liability case filed by plaintiff K.W., now seven years old. K.W. alleged claims of strict liability and negligence, asserting that premature infant formula manufactured by Mead Johnson and co-defendant Abbott contributed to cause him to develop necrotizing enterocolitis, a serious gastrointestinal condition, in September 2017 when he was a few weeks old. Defense counsel secured the verdict after plaintiff’s counsel requested more than $6.27 billion in compensatory and punitive damages against Mead Johnson and Abbott.

Sherry Knutson and Charissa Walker represented Mead Johnson with assistance from James Mizgala, Madeline Dennis, Brenda Sweet, Kelly Baldini, and Brooke Pauley.  Covington & Burling LLP served as lead trial counsel for Mead Johnson.
