On July 10, Mollie Benedict co-presented “Injunctions without Due Process: Combatting Anti-Competitive Actions on E-Commerce Platforms” at the IADC 2023 Annual Meeting. Mollie and her co-presenters discussed the recent uptick in the number of competitor complaints submitted to Amazon and the company’s process of taking action first and asking questions later – effectively removing the product from the market and – in the case of fake reviews – reducing the seller’s status. The panel discussed the process and how to litigate or defend against these claims, providing a good understanding of what intellectual property can be enforced on Amazon, what to do when asserting it, and how to respond if targeted.
