Bloomberg Law quoted Keith Grady in “Guiding Private Equity Companies’ Third Bite at the R&D Apple.” Keith provided comments on the article, which addresses commercialization, IP licensing, secondary market financing, securitization due diligence performed in licensing transactions, establishing/growing a stream of licensing revenues and receivables, and aggregating a viable stockpile of securitizable licenses.

Keith commented, “The securitization program outlined in this excellent article has the potential to enhance the value of a firm’s intellectual property without the costs and risks associated with enforcement actions. In my experience of over 30 years in intellectual property litigation, the barriers to entry (the costs of litigation and the risks of invalidation) frequently deter firms from monetizing their IP assets through enforcement campaigns. Securitization provides an alternative path to the same destination (generation of revenue) without the accompanying risks, thereby making the program attractive to even the most risk averse investors.”
