DePuy Orthopaedics Wins Defense Verdict in Hip Implant Case

April 2013

On April 16, DePuy Orthopaedics, Inc., a Johnson & Johnson subsidiary, obtained a defense verdict in a metal-on-metal ASR XL hip implant case in Cook County, Illinois. (Carol Strum v. DePuy Orthopaedics Inc. et al.) The plaintiff claimed a defect in the implant’s design resulted in its shedding debris into patients’ bodies and making the device prone to fail prematurely. The Chicago (Cook County) jury found in favor of Depuy, rejecting Strum’s request for $5 million in compensatory damages and $30 million in punitive damages. Tucker Ellis partner Sanford Watson was part of the trial team representing DePuy. The case was the second ASR case to go to verdict.
